What type of Will do I need?

Dark Green Paper Structures

Having a Will is one of the most important ways to ensure that your interests, your loved ones and your estate are protected.

Choose from three Will packages that best suit your needs and circumstances.

Once ordered, a lawyer will be in touch to obtain instructions from you on how you would like your Will drawn.

Basic Will

A Basic Will is great for a person who simply wants to leave their whole estate to their significant other or their family and/or kids in equal shares, and to appoint an appropriate trustee and executor/executrix to administer their estate.

If your situation is consistent with the above, a Basic Will is a great way to get started. You should consider a Basic Will if you are not planning to get married in the near future, do not have any children from a prior relationship and do not plan on leaving anyone out of your Will who may expect to receive particular assets or monies from your estate.

Choosing a Basic Will is great if you do not think you need a consultation with a lawyer for advice, but just want a legally binding document drawn that reflects how you want your estate to be divided. Choosing a Basic Will is also great because unlike an online computer-generated Will or a DIY Will Kit (that can be fraught with danger and ambiguity), you receive the peace of mind of having a lawyer draw the Will, just for you.

Standard Will

If your situation is still relatively simple and straightforward, but you would like to do a little more just than just leave your estate to your partner and/or children, a Standard Will might be more appropriate. This might include wanting to gift certain personal items to friends, having a certain desire for whether you want to be cremated or buried or if you are wanting leave a portion of your estate to a charity.

You should also consider a Standard Will if you are not planning to get married in the near future, do not have any children from a previous relationship and do not plan on leaving anyone out of your Will who may expect to receive particular assets or monies from your estate.

Choosing a Standard Will is great if you want a Basic Will but also want the peace of mind of a consultation with a lawyer to discuss your estate planning in the preparation of your Will.

Premium Will

If your situation is a bit more complex, and you think you need a consultation with a lawyer, a Premium Will may be great for you.

You should also consider a Premium Will if you intend to leave someone out of your Will (who might otherwise expect a share of your estate), have an interest in an ongoing business, have assets or commercial interests overseas or have investments in trusts and companies or if you have children from a past relationship.

If any of these apply to you, you will need to order a Premium Will.
